TERMS OF REFFERENCE (TOR) FOR CONSULTANCY ON NATIONAL WORKSHOP ON DEVELOPMENT OF CRPD IMPLEMENTATION PLAN
INTRODUCTION: From Rights to Inclusion Project
“From Rights to Inclusion project,” is being implemented by Handicap International (HI) with two national federations of Disabled Persons Organizations (DPO) – Shirikisho la Vyama vya Watu wenye Ulemavu Nchini Tanzania (SHIVYAWATA) and the United Disabled Persons of Kenya (UDPK). The project also partners with national government representatives from the Tanzanian Ministry of Health and Social Welfare (MOHSW) and the Kenyan National Council of Persons with Disabilities (NCPWD). At the regional level, the project partners with East African Disability Federation (EAFOD) and with the African Union’s (AU), Commission on Social Affairs and its secretariat of the African Decade of PWD. At a global level, the project partner is Mobility International USA (MIUSA) with a renowned expert on gender, disability and leadership
The project entitled “Harambee ya Uhuru na Umoja – From Rights to Inclusion In Kenya and Tanzania” is being implemented over a period of twenty months in twenty five counties in Kenya, and twenty regions in Tanzania. The project is funded by the US State Department.
The project aims at moving forward the protection of rights for persons with disabilities as outlined in the Convention on the Rights of Persons with Disabilities (CRPD) and national legislation. The project will empower persons with disabilities and DPOs with the understanding, skills and experience to use a rights-based approach to advocacy. The project will also strengthen DPOs to work with the government and the wider rights community, to achieve lasting improvements in the observance of the rights of persons with disabilities. It will also improve the implementation of the CRPD through strengthened grass roots, national and regional capacities and linkages.
Legal Framework in Tanzania
The government of Tanzania has ratified the UNCRPD since 2009 and enacted the persons with disability Act 2010 and its regulations of 2012. Despite the existence of the national and international policies, laws and regulations on the rights of persons with disabilities, most of people with disabilities, law enforcers and development actors are not aware of them and or what they entail. Therefore, Persons with disability in Tanzania live in deplorable conditions due to social economic and legal barriers which prevent their integration into all aspects of life, as well as enjoyment and exercising basic human rights and freedoms.
Justification
It is important for the Ministry of Health and Social Welfare to prepare the national implementation action plan on CRPD. This is based on the fact that, Rights holders and duty bearers, development actors will have a basis to implement, monitor and/or advocate for the rights, duties and obligations of PWD as per UNCRPD.
In recognizing the importance of the UNCRPD implementation, the Ministry of Health and Social Welfare in collaboration with SHIVYAWATA and Handicap international have joined hands to prepare action plan on the implementation of CRPD. The Action plan on CRPD will be shared with different stakeholders during the National workshop that is expected to take place on February, 2015.
The objectives of the National workshop are as follows;
- To further the enforcement of the CRPD by developing national action plan.
- To promote implementation of the rights of persons with disabilities in Tanzania based on UNCRPD and national disability Act.
- To mainstream the government ministries to enforce the CRPD.
- A. Responsibilities of Consultant
- To design and develop national Action Plan on CRPD implementation
- To act as moderator and rapporteur during the workshop
- To develop the national action plan and share with MOHSW, HI and SHIVYAWATA until it is finalized and agreed upon
- To advice the MoHSW on how to implement the CRPD with different actors
- To build capacity to MoHSW in understanding the CRPD and National disability Act.
- To advice and moderate the technical committee during preparatory meeting and national planning workshop
- B. CONSULTANT’S PROFILE
- Bachelor’s degree in Social Sciences, master’s degree preferred
- Experience in working with persons with disability and legal frameworks on Disability
- A good understanding on UN Convention on the rights of persons with Disability
- Experience in working with government institutions and developing national action plans
- Working languages required are English and Kiswahili

- D. WORK SCHEDULE
On the basis of the proposed timetable laid down in these Terms of Reference, the Consultant must set up a work schedule for the performance of the service.
The work schedule must clearly specify the manner in which the Consultant will approach the activities required to perform the service.
The schedule must indicate the progress and/or the standard of service performance, including the criteria and/or indicators to check that the service provision is proceeding smoothly.
- REPORT
HI will require a final report and National plan of actions on CRPD implementation to be submitted.
Submission date: 17th March, 2015
- RESOURCE PERSON
Within the framework of the service provision, the Consultant will be asked to collaborate with Handicap International’s teams and in particular with Ms. Risala Msemo who will be the point of contact.
BUDGET
The professional fee for the consultancy is USD. 1500 (All inclusive) Contract and Application Process
A contract will be drawn up after a call for expression of interest where skills and costs of potential consultants will be assessed and evaluated by SHIVYAWATA and Handicap International. The contract will be a formal consultancy contract between SHIVYAWATA and the consultant.
Tanzanian nationals or candidates already residing and eligible to work in Tanzania are encouraged to apply.
