The Tanzania Federation of Disabled People’s Organizations (SHIVYAWATA) is a non-governmental federation established in 1992 and brings together ten national Disabled People’s Organizations (DPOs) for advocating Disability rights, needs and issues.   • At least three years working experience in accounting field especially in donor funded projects.
  • Prior working experience in Disabled People’s Organization (DPOs) and Pro Disability Organizations (PDOs) will be of good advantage.
  • A skill on computer application, knowledge of Microsoft Excel is of at most importance.
  • Must be fluent in English and Swahili languages.

A CALL FOR CONSULTANT TO DRAFT CRPD ALTERNATIVE REPORT FOR TANZANIA

TERMS OF REFERENCE FOR A CONSULTANT TO DRAFT THE CRPD ALTERNATIVE REPORT FOR TANZANIA: 2015

 1. INTRODUCTION:

 The UN Convention on the Rights of Persons with Disabilities aimed at promoting and protecting the rights and dignity of persons with disabilities in the world. It is the first legally binding treaty to clearly set out the obligations on states to avoid discrimination against persons with disability in all its forms, and to create a society in which the rights and dignity of persons with disability are respected.

 The treaty asserts the rights of persons with disabilities such as education, health, work, and adequate living conditions, freedom of movement, freedom from exploitation, self-representation, participation in the political and governance processes as well as equal recognition before the law to mention just a few.

 The Government of United Republic of Tanzania ratified the CRPD on 10th November 2009 and enacted the persons with disability Act 2010 and its regulation of 2012. The UNCRPD and the national disability legislations have the duty to ensure that human rights and fundamental freedoms for all persons with disabilities are protected and promoted without discrimination.  Persons with disabilities need to enjoy equal rights as other citizen and become aware of their rights as stated in the CRPD and national legislations.  Moreover, the convention provides PWDs an opportunity to increase awareness of their rights.

 Article 33 of the CRPD obliges state parties that are signatory to the CRPD to ensure the participation of persons with disabilities in the national implementation and monitoring of CRPD. The treaty requires the states that have ratified the convention to prepare National reports to the UN Committee of expert on the implementation and in accordance with the provisions of article 33, civil society in particular persons with disabilities through their organizations also have the monitoring role. Despite ratifying the CRPD six years ago, Tanzania has never presented its report yet to the CRPD committee on the implementation status of CRPD.

 Therefore, Tanzania as signatory to the convention is obliged to develop a report on CRPD implementation for review by the CRPD Committee. On the other hand, DPOs and civil society organizations entitled to develop recommendations to the CRPD committee in the form of shadow/alternative report, in order to enhance the realization of rights of PWDs as set out in the Convention.

 Based on this ground, Handicap International provides a financial support to SHIVYAWATA as an umbrella organization of Disabled Persons Organizations (DPOs) to coordinate the processes of developing alternative report on the status of CRPD implementation in Tanzania.

 2. METHODOLOGY

 The report will comprise both primary and secondary information. The primary information will be obtained through interviews and questionnaires. The secondary information is from publications and human rights reports.

SHIVYAWATA needs the consultant services to consolidate the research process and to support the drafting of the Alternative report. It also identifies and selects eight persons to form a technical committee to assist consultant in all stages of alternative report writing.

The Roles of the consultant are:

  • To develop Action Plan on the Alternative report
  • To conduct capacity building to the Shivyawata staff and leaders on the process of alternative report writing.
  • Develop a framework of alternative report
  • Attending and leading the technical committee meetings.
  • To ensure collection of information from different stakeholders with regard to the realization of the rights of PWDs as spelt out in the CRPD for facilitating the report writing processes
  • To develop research tools and conduct research to government authorities and other key informants on the implementation status of CRPD in Tanzania.
  • To ensure collection and compilation of case studies from DPOs that can be used as evidence in the alternative report.
  • To draft the alternative report using the guidelines set by the CRPD committee and present to the technical committee for review.
  • To moderate and facilitate stakeholders meetings
  • To incorporate the views from stakeholders and submit a final report to Shivyawata.
  • And any other duties related

3. CONSULTANT’S PROFILE

 Bachelor’s degree in law, Social Sciences, master’s degree preferred with a bias on disability rights studies

  • Experience in working with persons with disability and legal frameworks on Disability
  • A good understanding on UN Convention on the rights of persons with Disability
  • Working languages required are English and Kiswahili

4. WORK SCHEDULE

It is anticipated that this work will take about 20 working days.

On the basis of the proposed number of days in these Terms of Reference, the Consultant must set up a work schedule for the performance of the service.

The work schedule must clearly specify the manner in which the Consultant will approach the activities required to perform the service.

The schedule must indicate the progress and/or the standard of service performance, including the criteria and/or indicators to check that the service provision is proceeding smoothly

5. REPORT

HI and SHIVYAWATA will require CRPD Alternative report for TANZANIA to be submitted.

Submission date: 31/3/2015

6. RESOURCE PERSON

Within the framework of the service provision, the Consultant will be asked to collaborate with Handicap International’s teams and in particular with Ms. Risala Msemo who will be the point of contact.

7. BUDGET

The professional fee for the consultancy; Attractive but negotiable.

A contract will be drawn up after a call for expression of interest where skills and costs of potential consultants will be assessed and evaluated by SHIVYAWATA and Handicap International. The contract will be a formal consultancy contract between SHIVYAWATA and the consultant.

A Call for Application: Consultancy on national plan of action for CRPD implementation 

TERMS OF REFFERENCE (TOR) FOR CONSULTANCY ON NATIONAL WORKSHOP ON DEVELOPMENT OF CRPD IMPLEMENTATION PLAN

 INTRODUCTION: From Rights to Inclusion Project

“From Rights to Inclusion project,” is being implemented by Handicap International (HI) with two national federations of Disabled Persons Organizations (DPO) – Shirikisho la Vyama vya Watu wenye Ulemavu Nchini Tanzania (SHIVYAWATA) and the United Disabled Persons of Kenya (UDPK). The project also partners with national government representatives from the Tanzanian Ministry of Health and Social Welfare (MOHSW) and the Kenyan National Council of Persons with Disabilities (NCPWD). At the regional level, the project partners with East African Disability Federation (EAFOD) and with the African Union’s (AU), Commission on Social Affairs and its secretariat of the African Decade of PWD. At a global level, the project partner is Mobility International USA (MIUSA) with a renowned expert on gender, disability and leadership

The project entitled “Harambee ya Uhuru na Umoja – From Rights to Inclusion In Kenya and Tanzania” is being implemented over  a period of twenty months in twenty five counties in Kenya, and twenty regions in Tanzania.  The project is funded by the US State Department.

The project aims at moving forward the protection of rights for persons with disabilities as outlined in the Convention on the Rights of Persons with Disabilities (CRPD) and national legislation. The project will empower persons with disabilities and DPOs with the understanding, skills and experience to use a rights-based approach to advocacy. The project will also strengthen DPOs to work with the government and the wider rights community, to achieve lasting improvements in the observance of the rights of persons with disabilities. It will also improve  the  implementation  of  the  CRPD  through  strengthened  grass  roots,  national  and regional capacities and linkages.

Legal Framework in Tanzania

The government of Tanzania has ratified the UNCRPD since 2009 and enacted the persons with disability Act 2010 and its regulations of 2012. Despite the existence of the national and international policies, laws and regulations on the rights of persons with disabilities, most of people with disabilities, law enforcers and development actors are not aware of them and or what they entail. Therefore, Persons with disability in Tanzania live in deplorable conditions due to social economic and legal barriers which prevent their integration into all aspects of life, as well as enjoyment and exercising basic human rights and freedoms.

Justification

It is important for the Ministry of Health and Social Welfare to prepare the national implementation action plan on CRPD.  This is based on the fact that, Rights holders and duty bearers, development actors will have a basis to implement, monitor and/or advocate for the rights, duties and obligations of PWD as per UNCRPD.

In recognizing the importance of the UNCRPD implementation, the Ministry of Health and Social Welfare in collaboration with SHIVYAWATA and Handicap international have joined hands to prepare action plan on the implementation of CRPD. The Action plan on CRPD will be shared with different stakeholders during the National workshop that is expected to take place on February, 2015.

The objectives of the National workshop are as follows;

  • To further the enforcement of the CRPD by developing national action plan.
  • To promote implementation of the rights of persons with disabilities in Tanzania based on UNCRPD and national disability Act.
  • To mainstream the government ministries to enforce the CRPD.

  • To develop the national action plan and share with MOHSW, HI and SHIVYAWATA until it is finalized and agreed upon
